GENERAL TERMS AND CONDITIONS OF SALE
Article 1 - Scope

hereinafter referred to as GOUBI,
to all sales concluded via the website www.goubicollection.com, with its non-professional customers.
In the case of an order from a country other than metropolitan France, the customer is the importer of the relevant products.
For all products shipped outside the EEA and DOM-TOM, customs duties and other local taxes may be applicable. These duties are not the responsibility of GOUBI. They will be the sole responsibility of the customer, who is advised to inquire about these aspects before placing any order.
These general terms and conditions of sale may be modified at any time, provided that these modifications are displayed on the website.
Article 2 – Prices
The prices of the products are indicated in Euros, all taxes included, excluding participation in processing and shipping costs for shipments within the European Zone. For shipments outside the European Union and DOM, TOM, prices are indicated in Euros excluding taxes. Local VAT and import fees will be requested by the carrier upon delivery of your package.
GOUBI reserves the right to modify its prices at any time, but products will be billed based on the rates in effect at the time the order is recorded, subject to availability.
Article 3 – Order
It is the customer's responsibility to select the products they wish to order on the website. Payment is made online by credit card, bank transfer, or Apple Pay. The order will be confirmed by email specifying the ordered references, the order amount, and the delivery address. The order will be shipped no later than 20 days after receipt of payment.
Article 4 - Acceptance of the general terms and conditions of sale
The customer declares that they have read and accepted these general terms and conditions of sale before placing their order. Therefore, the validation of the order constitutes acceptance of the general terms and conditions of sale. Unless proven otherwise, the data recorded byGOUBIconstitutes proof of the transaction.
Article 5 – Availability
The offers of products and prices are valid as long as they are visible on the site, within the limits of available stock. In the event of product unavailability after placing an order, the customer will be informed by email as soon as possible. Only the items shipped will be charged to you.
Article 6 – Delivery
Products are delivered to the delivery address provided by the customer during the ordering process. The delivery time includes the preparation time of the package and the shipping time. The order will only be processed after payment confirmation.
In case of delivery delay, the customer has the option to cancel the order.

Article 7 - Shipping costs
Shipping costs are generated automatically during the ordering process. GOUBI applies differentiated shipping rates based on the order amount, the geographical delivery area, and the mode of transport. The shipping amount is included in the order confirmation.
These costs include a contribution to preparation and packaging costs + postage costs + transport costs. Shipping costs are due for each order placed.
Article 8 – Payment
For online payment, it is necessary to follow the ordering process outlined on the site. Transactions are carried out in a secure environment compliant with SSL standards.
Article 9 - Transfer of ownership, transfer of risks
The transfer of ownership and the transfer of risks occur upon delivery of the goods that have been paid for in advance. The goods must be checked by the customer upon delivery. Any reservations should be noted on the delivery slip presented by the carrier or can be sent to GOUBI's sales department within 72 hours. In case of defects, the return costs are borne by GOUBI. The defective item will either be exchanged or refunded.
Article 10 - Right of withdrawal
Article 10.1 General case
The customer has a period of 15 days from the receipt of their order to inform GOUBI of their wish to return all or part of their order. After this period, the order will be considered firm and final.
During the Christmas period, return deadlines are exceptionally extended to 30 days.
To inform GOUBI of their wish to withdraw from all or part of their order, the customer can:
Make a return request by following the procedure indicated on the GOUBI website or on the delivery note received with the order. Exercise your right of withdrawal by downloading the withdrawal form here, and then sending it duly completed by email to customer service using the contact form on the site.
Contact our customer service by post (Goubi – 3 Chemin du Tameye – 06650 Opio) or by email atgoubi.antibes@gmail.com, clearly and unambiguously expressing your wish to withdraw from all or part of your order.
The customer then has a period of 14 days from the acknowledgment of their return request by GOUBI, evidenced by a return voucher, to return their goods to GOUBI. After this period, the return request will be cancelled, and the original order will be considered firm and final.
Items must be returned to us in their packaging and in their original condition, accompanied by the delivery note received with the order. Any non-compliant return will be rejected.
The return, deemed compliant by GOUBI, of all the ordered products will result in the issuance of a credit note by GOUBI corresponding to the total amounts paid by the customer, namely:
- Value of the goods paid for by the customer.
In the case of a return, deemed compliant by Goubi, of part of the ordered products, Goubi will issue a credit note corresponding to:
- Value of the returned goods, paid for by the customer.
Please note that discount vouchers and promotional codes do not entitle you to any credit.
This credit will result in a refund via the payment method used during the initial order.
Refunds will be processed within a maximum of 14 days after GOUBI receives the returned package.
Article 11 – Guarantees
Textile products undergo very strict controls at all stages of production. They are guaranteed against any premature wear for family use and against any lack of conformity of the item. Care instructions must be followed by the customer.
The products are manufactured and distributed in compliance with current French legislation. If, despite all precautions, an item is delivered damaged, in an incorrect size or colour, the customer can contact customer service.
The products are covered by the legal guarantee of conformity and GOUBI is liable for any lack of conformity of the item in accordance with articles L217-4 to L217-12 of the Consumer Code and for hidden defects of the sold item in accordance with articles 1641 to 1648 and 2232 of the Civil Code.
When the consumer acts under the legal guarantee of conformity:
- they benefit from a period of two years from the delivery of the item to take action;
- they can choose between repair or replacement of the item, subject to the cost conditions provided for in article L. 217-9 of the Consumer Code;
- they are exempt from proving the existence of the lack of conformity of the item during the twenty-four months following delivery, except for second-hand goods.
The legal guarantee of conformity applies regardless of any commercial guarantee that may be granted.
It is reminded that the consumer can decide to invoke the warranty against hidden defects of the sold item as defined in Article 1641 of the Civil Code and that in this case, they can choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Article 12 - Applicable Law – Dispute
For any complaint, the customer must contact the GOUBI Customer Service at +33603182128 to seek an amicable settlement.
In accordance with the provisions of the Consumer Code regarding the amicable settlement of disputes, GOUBI adheres to the mediation service of the Consumer Mediation Centre of Conciliators Justice (CM2C) whose contact details are as follows: 14 rue Saint-Jean - 75017 Paris.
After a prior written approach to the professional, the CM2C can be seized either:

These general terms and conditions of sale are subject to French law. In the event of a dispute, only French courts have jurisdiction.
Article 13 - Personal Data
In accordance with the General Data Protection Regulation that came into effect on 25 May 2018, GOUBI has established a charter for the protection of personal data. This charter is available on the website in a specific tab accessible to customers.
Personal data is used for the following processes, carried out directly by GOUBI.
- Managing the customer account, basket, and orders.
- Managing deliveries and order tracking.
- Providing personalised advertising content.
- Improving customer service.
- Contacting via email.
- Collecting reviews.
- Administering competitions, promotions, or surveys.
Customer data is retained for 3 years after the last purchase.
Everyone has the right to request access to personal data, rectification or deletion of such data, or a limitation of processing or to object to processing and has the right to data portability.
